Incident Description
On 9 June 2019 at 14:05 LMT, a pilot of a PZL Mielec M18 "Dromader" (registration SPFOK) departed from its base at Toruń Airport (EPTO) intending to fly to a fire in Nakło (point Oskar). The route passed through Bydgoszcz Airport (EPBY), for which the pilot obtained clearance from Bydgoszcz ATC. During the flyover, without ATC approval, the pilot deviated the aircraft's flight path to the right and discharged water near a festival at the old military tower. Without warning, the pilot executed a sharp right turn toward glider SP3234, which was in the right-hand circuit for runway 29. The water dump and turn were performed abruptly and without prior notification. Subsequently, the pilot reported returning to Toruń. This violated aviation law provisions regarding non-compliance with ATC clearance in the Bydgoszcz control zone.
Commission Decision
The Polish State Commission for Aircraft Accident Investigation (PKBWL), after reviewing documents from the investigation team, decided to discontinue the investigation into the serious incident. The decision was based on Article 135, paragraph 6, item 3 of the Aviation Law Act of 3 July 2002 (as amended), due to the fact that the aircraft had been built or was operated not in accordance with applicable regulations.
