Incident Overview
On July 24, 2020, an incident involving a powered paraglider occurred near the village of Pniówno in Chełm county, Poland. The aircraft was an unregistered powered paraglider with no identification marks. The incident was reported to the Polish State Commission on Aircraft Accident Investigation (Państwowa Komisja Badania Wypadków Lotniczych, PKBWL) via the Municipal Police Headquarters in Chełm.
Commission Decision
The PKBWL reviewed the documentation provided by the police. Acting under Article 135, paragraph 6 of the Aviation Law Act of July 3, 2002 (as amended), the commission decided to refrain from conducting an investigation into the incident. The decision was documented in resolution number 2026/20, dated September 3, 2020.
Reasons for Non-Investigation
The commission cited two specific reasons for its decision:
1. The aircraft at the time of the incident was being used by an unauthorized person. 2. The person operating the aircraft was under the influence of alcohol.
Because of these circumstances, the PKBWL determined that a formal investigation was not warranted. However, the commission resolved to notify both the police and the Polish Civil Aviation Authority (ULC) of the incident and to forward all gathered materials to these bodies for appropriate action.
